Terms of Service
These Terms of Service govern your access to and use of MAD, including mad-ads.com, public editorial content, account profiles, community features, editor/admin tools, AI-assisted content workflows, and future MAD+ or merch experiences.
1. Agreement to These Terms
By visiting or using MAD, you agree to these Terms of Service and our Privacy Policy. If you use MAD on behalf of a company, agency, or other organization, you represent that you have authority to bind that organization.
If you do not agree to these terms, do not use the website, create an account, submit information, or access restricted MAD features.
2. What MAD Provides
MAD provides marketing content, case studies, news, learning materials, community access, profile features, and editorial tools. Some features may be public, some may require an account, and some may be limited to editors, admins, MAD+ members, or approved community members.
MAD may change, suspend, or discontinue any feature at any time. We may also test experimental features, including AI-assisted drafting, localization, content workflows, merch, subscriptions, and paid access.
3. Accounts and Eligibility
You must provide accurate information when creating or updating an account, including your name, email address, phone number, and profile details. You are responsible for keeping your login credentials secure and for all activity under your account.
You may not create an account using false information, impersonate another person, use another person's credentials, or transfer your account without our permission. MAD may suspend or terminate accounts that violate these terms or create risk for the platform.
4. Community Access
Community access may require review and approval. MAD may approve, reject, limit, suspend, or remove community access at its discretion, including where we believe conduct is abusive, unsafe, misleading, unlawful, spammy, or inconsistent with the purpose of the community.
You are responsible for what you post or share in community spaces. Do not disclose confidential information, harass others, collect data from other members without permission, or use community access for unsolicited promotion.
5. Acceptable Use
- Do not use MAD for unlawful, harmful, fraudulent, deceptive, abusive, harassing, or discriminatory activity.
- Do not attempt to bypass authentication, authorization, row-level security, paywalls, member checks, rate limits, or admin/editor restrictions.
- Do not interfere with the website, servers, databases, storage buckets, APIs, email systems, or security controls.
- Do not scrape, crawl, copy, index, or harvest MAD content, user data, or platform data at scale without written permission.
- Do not upload malware, exploit code, corrupted files, illegal content, or files that violate another person's rights.
- Do not submit content that infringes copyrights, trademarks, privacy rights, publicity rights, contractual rights, or other legal rights.
- Do not misrepresent your affiliation with MAD or imply endorsement where none exists.
6. User Content and Profile Materials
You keep ownership of information, images, text, and other materials you submit to MAD, but you grant MAD a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify, and use that content as needed to operate, improve, secure, and promote the platform.
If you upload a profile photo, you understand it may be publicly visible. You represent that you have the rights needed to upload and use any content you submit.
7. MAD Content and Intellectual Property
MAD and its licensors own the website, design, brand elements, editorial content, software, databases, workflows, templates, graphics, and other platform materials, except for content submitted by users or third parties.
You may read and share links to public MAD content for personal or professional use. You may not copy, reproduce, modify, translate, sell, republish, distribute, or create derivative works from MAD content without permission, except where allowed by law.
8. Editorial and Educational Content
MAD content is provided for informational, educational, and editorial purposes. It is not legal, financial, investment, tax, employment, medical, or professional advice. Marketing examples and case studies may involve third-party brands, public sources, or historical results that may not apply to your situation.
We try to keep content useful and accurate, but we do not guarantee that all content is complete, current, error-free, or suitable for your business decisions.
9. AI-Assisted Features
MAD may use AI-assisted tools to draft, translate, summarize, localize, or support editorial workflows. AI-generated material may be incomplete, inaccurate, or require human review. MAD policy is that AI drafts should not auto-publish without editorial approval.
If you use editor/admin features, you are responsible for reviewing AI-assisted outputs before publishing or relying on them. MAD may store prompts, source snapshots, dictionary entries, generated drafts, model names, confidence scores, and reviewer activity for workflow and quality purposes.
10. Payments, MAD+, and Merch
The application may include subscription tiers, MAD+ labels, payment-related fields, merch pages, or future checkout scaffolding. Unless a payment provider and checkout flow are explicitly active, these features are not a live paid service.
If paid features launch, the price, billing cycle, taxes, renewal terms, cancellation rules, refund rules, and payment provider terms shown at checkout will apply. MAD may change paid features or pricing with appropriate notice where required.
11. Third-Party Services and Links
MAD may link to or integrate with third-party services, including Supabase, Resend, Listmonk, OpenAI, hosting providers, social platforms, embedded media, source websites, and operational tools. Third-party services are governed by their own terms and privacy policies.
We are not responsible for third-party websites, content, services, security practices, or data handling. Accessing third-party links is at your own risk.
12. Security and Access Controls
You may not test, scan, attack, bypass, or interfere with MAD systems without written authorization. If you discover a vulnerability, report it responsibly and do not access, modify, delete, copy, or disclose data that does not belong to you.
MAD may monitor platform activity, investigate suspicious behavior, remove content, restrict accounts, and cooperate with service providers or authorities where necessary to protect the service.
13. Termination
You may stop using MAD at any time. MAD may suspend or terminate access to accounts, community features, editor/admin areas, or the entire service if we believe you violated these terms, created legal or security risk, abused the service, or acted inconsistently with MAD's purpose.
After termination, some provisions will continue to apply, including intellectual property, user content licenses, disclaimers, limits of liability, indemnity, governing law, and dispute terms.
14. Disclaimers
MAD is provided on an as-is and as-available basis. To the maximum extent allowed by law, MAD disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and uninterrupted operation.
We do not guarantee that the website will always be available, that content will be error-free, that defects will be corrected, or that the service will meet your expectations.
15. Limitation of Liability
To the maximum extent allowed by law, MAD and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or loss of goodwill arising from your use of the service.
Where liability cannot be excluded, MAD's liability will be limited to the greater of the amount you paid to MAD for the relevant service in the three months before the claim or USD 100.
16. Indemnity
You agree to defend, indemnify, and hold MAD harmless from claims, damages, losses, liabilities, costs, and expenses arising from your use of the service, your content, your violation of these terms, your violation of law, or your infringement of another person's rights.
17. Changes to These Terms
MAD may update these terms as the product, law, or business changes. The updated terms will be posted on this page with a new last-updated date. Continued use after changes means you accept the updated terms.
